{"id":4567,"date":"2018-05-28T15:18:42","date_gmt":"2018-05-28T20:18:42","guid":{"rendered":"https:\/\/www.brandonu.ca\/hr\/?page_id=4567"},"modified":"2021-01-13T13:46:59","modified_gmt":"2021-01-13T19:46:59","slug":"duty-to-accommodate","status":"publish","type":"page","link":"https:\/\/www.brandonu.ca\/hr\/accessibility\/duty-to-accommodate\/","title":{"rendered":"Duty to Accommodate"},"content":{"rendered":"<h4>Manitoba Human Rights Code &#8211; Duty to Accommodate<\/h4>\n<p>At Brandon University, we recognize our responsibility to address and remove barriers that staff and faculty may encounter based on the protected characteristics identified in the Manitoba Human Rights Code.\u00a0\u00a0 By doing so, we are meeting our duty to accommodate.<\/p>\n<p>The Manitoba Human Rights Code (&#8220;The Code&#8221;) prohibits an employer from discriminating against a person based on various characteristics including physical or mental disability, family status, religious belief and gender identity.\u00a0 For a full list of the protected characteristics, please visit the <a href=\"http:\/\/web2.gov.mb.ca\/laws\/statutes\/ccsm\/h175e.php\">Manitoba Human Rights Commission website<\/a>.\u00a0 Discriminating also means a failure to provide a reasonable accommodation for the needs of a person when they are based on the protected characteristics.*\u00a0 As the employer, it is our obligation to &#8216;level the playing field&#8217;\u00a0 through reasonable accommodations so that all employees have equal access to opportunities at work.\u00a0 The Manitoba Human Rights Commission has developed a helpful guideline regarding <a href=\"http:\/\/www.manitobahumanrights.ca\/v1\/education-resources\/resources\/pubs\/guidelines\/booklet-reas-accom-guideline-march-2017.pdf\">Reasonable Accommodation in the Workplace<\/a>.<\/p>\n<p>No two accommodations look the same.\u00a0 Accommodations can take many forms; from adjusting work start times to ergonomic workstation adjustments.\u00a0\u00a0Should these types of accommodations be medically required, Human Resources will request supporting medical documentation to accompany the <a href=\"https:\/\/www.brandonu.ca\/ama\/files\/Accommodation-Request-form-approved.pdf\">Accommodation Request form<\/a>.<\/p>\n<p>It is important to remember that an accommodation request is based on a\u00a0<strong><em>n<\/em><em>eed<\/em><\/strong> not a <strong><em>w<\/em><em>ant<\/em><\/strong>.\u00a0\u00a0 While an employee may view their want as a need,\u00a0 they do not get to choose their accommodation.\u00a0 As the employer, we require supporting documentation from practitioners or physicians\u00a0and we\u00a0will often request subsequent information to assist us in determining what is practicably reasonable.<\/p>\n<p>To help better understand workplace accommodations, take the time to review the following policy, procedure and supporting forms:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.brandonu.ca\/ama\/files\/Accommodation-Policy.pdf\">Workplace Accommodation Policy<\/a><\/li>\n<li><a href=\"https:\/\/www.brandonu.ca\/ama\/files\/Accommodation-Procedure-approved-1.pdf\">Workplace Accommodation Procedure<\/a><\/li>\n<li><a href=\"https:\/\/www.brandonu.ca\/ama\/files\/Accommodation-Request-form-approved.pdf\">Accommodation Request Form<\/a><\/li>\n<li><a href=\"https:\/\/www.brandonu.ca\/ama\/files\/Accommodation-Planning-Checklist-for-manager-use-only-fillable-version.pdf\">Accommodation Plan Checklist (for managers)<\/a><\/li>\n<li><a href=\"https:\/\/www.brandonu.ca\/ama\/files\/Workplace-Accommodation-Plan-fillable-version-1.pdf\">Workplace Accommodation Plan<\/a><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4>Return to Work &#8211; Duty to Accommodate<\/h4>\n<p>In cases where an employee is set to return to work after an illness or injury, there are often restrictions or limitations\u00a0as part of their\u00a0return to work plan.\u00a0 Because we are required to ensure the employee does not\u00a0exceed their limitations and possibly risk further injury or setbacks to their recovery, Human Resources will ask for medical documentation outlining any restrictions prior to the employee&#8217;s return to work.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h6>*The Manitoba Human Rights Commission, <em>Reasonable Accommodation in the Workplace &#8211; Your Rights, Your Responsibilities.*<\/em><\/h6>\n","protected":false},"excerpt":{"rendered":"<p>Manitoba Human Rights Code &#8211; Duty to Accommodate At Brandon University, we recognize our responsibility to address and remove barriers that staff and faculty may encounter based on the protected characteristics identified in the Manitoba Human Rights Code.\u00a0\u00a0 By doing so, we are meeting our duty to accommodate.
